This Privacy Policy is provided as a general template and starting point. It is not legal advice. Before launch, have it reviewed by qualified counsel and tailored to your actual data practices, vendors, and the jurisdictions you operate in (including any HIPAA obligations that apply to your pharmacy and provider partners).
1. Who this policy covers
This Privacy Policy applies to semax.clinic and the services offered through it (the "Services"), operated by Semax Health, Inc. ("Semax," "we," "us," or "our"). It describes how we handle information about visitors, prospective customers, and customers.
Certain health information you provide may be handled by our partner licensed providers and compounding pharmacies under their own privacy practices and, where applicable, the Health Insurance Portability and Accountability Act (HIPAA). Where those entities act as "covered entities," their notices govern that information; this policy governs information we collect and process directly.
2. Information we collect
We collect information in three ways: directly from you, automatically through your use of the Services, and from third parties.
Information you provide
- Account & contact data: name, email, phone number, shipping and billing address.
- Assessment & health data: responses to the eligibility assessment, health history, medications, and symptoms you choose to share.
- Order & payment data: products ordered, subscription details, and payment information (processed by our payment processor — we do not store full card numbers).
- Communications: messages you send to support, reviews, and survey responses.
Information collected automatically
- Device & usage data: IP address, browser type, pages viewed, referring URLs, and timestamps.
- Cookies & similar technologies: see the Cookies section below.
Information from third parties
- Our partner providers and pharmacies (e.g., order and fulfillment status).
- Payment processors, fraud-prevention services, and analytics or advertising partners.
3. How we use information
We use information to:
- Provide, operate, and improve the Services, including processing your assessment and orders.
- Facilitate the provider review and pharmacy fulfillment that make the program possible.
- Communicate with you about orders, your subscription, support requests, and service updates.
- Personalize content, measure performance, and develop new features.
- Detect, prevent, and address fraud, abuse, and security issues.
- Comply with legal obligations and enforce our Terms & Conditions.
- Send marketing communications, where permitted — you can opt out at any time.
4. Health information
The assessment may involve sensitive health information. We treat this information with heightened care and use it to determine eligibility, facilitate provider review, and support appropriate fulfillment. We do not sell health information, and we do not use it for cross-context behavioral advertising. Access is limited to personnel and partners who need it to deliver the Services.
5. When we share information
We do not sell your personal information for money. We share information only as described here:
- Providers & pharmacies: licensed clinicians and compounding pharmacies who review eligibility and fulfill orders.
- Service providers: vendors that host our site, process payments, ship orders, send email, prevent fraud, and provide analytics, under contracts that limit their use of the data.
- Legal & safety: when required by law, subpoena, or to protect the rights, property, or safety of Semax, our customers, or others.
- Business transfers: in connection with a merger, acquisition, financing, or sale of assets, subject to this policy.
- With your consent: when you direct us to share information.
6. Cookies & tracking technologies
We and our partners use cookies, pixels, and similar technologies to keep you signed in, remember preferences, measure traffic, and (with consent where required) support advertising. You can control cookies through your browser settings and, where offered, our cookie preferences tool. Blocking some cookies may affect how the Services function.
7. Advertising & analytics
We may work with analytics and advertising partners (for example, to understand site performance and reach relevant audiences). These partners may set their own cookies and process device identifiers. Where required by law, we obtain consent before using these technologies, and we honor recognized opt-out signals such as Global Privacy Control (GPC) where applicable. We do not use sensitive health information for targeted advertising.
8. Data retention
We keep personal information for as long as needed to provide the Services, comply with legal, tax, and recordkeeping obligations (including pharmacy and medical recordkeeping requirements), resolve disputes, and enforce our agreements. When information is no longer needed, we delete or de-identify it.
9. How we protect data
We use administrative, technical, and physical safeguards designed to protect personal information, including encryption in transit, access controls, and vendor due diligence. No method of transmission or storage is perfectly secure, so we cannot guarantee absolute security.
10. Your privacy rights
Depending on where you live (for example, California, Colorado, Virginia, and other U.S. states with privacy laws), you may have the right to:
- Access or receive a copy of the personal information we hold about you.
- Correct inaccurate information.
- Delete your information, subject to legal exceptions.
- Opt out of "sale" or "sharing" for cross-context behavioral advertising and certain profiling.
- Withdraw consent and unsubscribe from marketing communications.
- Not be discriminated against for exercising your rights.
To make a request, email privacy@semax.clinic. We will verify your identity before fulfilling a request and respond within the time required by applicable law. You may use an authorized agent where the law allows.
11. Children's privacy
The Services are intended for adults 18 and older. We do not knowingly collect personal information from children. If you believe a child has provided us information, contact us and we will delete it.
12. Changes to this policy
We may update this policy from time to time. When we do, we will revise the "Last updated" date above and, for material changes, provide additional notice. Your continued use of the Services after an update means you accept the revised policy.
